1. ELIGIBILITY: This Sweepstakes is open to: (i) legal residents of the fifty (50) United States and the District of Columbia (D.C.) (excluding Virginia, Massachusetts, & Michigan), (ii) who are 21 years of age at the time of entry, and (iii) who are ZYN Rewards Members and current nicotine user as of May 25, 2025. The following individuals are not eligible to enter or win a prize: employees, contractors, directors, and officers of Swedish Match North America LLC (“Sponsor”), its parent, subsidiary and affiliated companies, and the web design, advertising, fulfillment, legal, judging, administrative, groups, clubs, organizations, commercial entities and businesses and Sweepstakes agencies involved in the administration, development, fulfillment, and execution of this Sweepstakes including Marketing Resources, Inc. (collectively, “Sweepstakes Parties”), and the immediate family members (spouse, parent, child, sibling, grandparent, and spouse or "step" of each) and those living in the same household of each such person (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Sweepstakes). Void in VA, MA, and MI and where prohibited by law and subject to all federal, state, and local laws.
2. SWEEPSTAKES PERIOD: Sweepstakes begins on June 2, 2025 at 9:00:00 AM Eastern Time, and ends on June 6, 2025 at 9:00:00 PM Eastern Time (“ET”) (the “Sweepstakes Period”). The Sweepstakes consists of six (6) separate, distinct, and independent entry pools (each an “Entry Pool”).
3. TO ENTER: During the Sweepstakes Period, visit https://us.zyn.com (the “Website”) and log into your ZYN account. After logging into your ZYN account, you will need to access the sweepstakes page and will be presented with six (6) trips as follows, the Golf Elite, Serenity Seeker, Music Maker, Taste Boss, Trail Blazer, and Downhill Thrill (each with a separate Entry Pool). You will then be required to select the one trip/Entry Pool that you would like to be entered into, and once you press “submit” you will receive one (1) entry into such Entry Pool. Limit of (1) one total entry into the Sweepstakes - you may not enter into multiple Entry Pools.
Entrant must complete all required steps and provide any and all required information and comply with any applicable restrictions or requirements set forth herein to receive a valid entry. Entrants must agree to these Official Rules to receive an entry into any Entry Period. Individuals who do not follow all of the instructions, provide the required information, and/or abide by these Official Rules or other instructions of Sponsor may be disqualified. Other entry methods than those outlined above are void and will not receive entry.
Automated entries are prohibited, and any use of automated devices will cause disqualification. Entrants may not enter with multiple e-mail addresses nor may entrants use any other device or artifice to enter multiple times or as multiple entrants. Any entrant who attempts to enter with multiple e-mail addresses, under multiple identities, or uses any device or artifice to register multiple times will be disqualified and forfeits any and all prizes won, in Sponsor’s sole discretion. Multiple entrants are not permitted to share the same e-mail address. Should multiple users of the same e-mail account enter the Sweepstakes and a dispute thereafter arise regarding the identity of the entrant, the authorized account holder of said e-mail account at the time of entry will be considered the entrant. “Authorized Account Holder” is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization which is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. Potential winner may be required to show proof of being the Authorized Account Holder.
4. DRAWINGS AND ODDS OF WINNING: On or about June 12, 2025, Sponsor (or its administrator) will randomly select three (3) potential winners from each Entry Pool, from among all eligible entries received for such Entry Pool. Sponsor and administrator’s decisions shall be final and binding in all matters relating to the Sweepstakes. Odds of winning a Grand Prize depend on the number of eligible entries received during the Sweepstakes Period.
5. SWEEPSTAKES PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”): There are a total of six (6) prizes to be awarded in connection with this Sweepstakes as follows:
Any guest must be at least twenty-one (21) years of age or older at the time of booking in order to accompany any winner on any trip.
PRIZE DETAILS AND RESTRICTIONS: Actual value of each prize may vary depending on winner’s point of travel origin, airfare and hotel fluctuations. Any difference between the stated ARV and actual value will not be awarded. Exact airport, airline, hotel accommodations, and any other prize details will be determined by the Sponsor in its sole discretion. Prizes are non-transferable and no cash redemption or prize substitution permitted, except at the sole discretion of the Sponsor. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right in their sole discretion to substitute a prize in whole or in part with one of comparable or greater value than value of prize at the time of the Sweepstakes starts. All costs and expenses associated with prize acceptance and use not specifically provided herein are the responsibility of the winner. The ARV for each prize is as of the date these rules were finalized and may fluctuate. Any difference between the stated ARV and actual value at the time the prize was awarded will not be awarded.
Gift card is subject to terms, conditions, and restrictions as set by issuer. All prize details not specified in the Official Rules will be determined in Sponsor’s sole and absolute discretion. Selection of the airline, departure and arrival airport, and hotel are solely within Sponsor’s sole discretion. If in the judgment of Sponsor, air travel is not required due to a winner's proximity to their prize location, ground transportation will be substituted for roundtrip air travel at Sponsor’s sole and absolute discretion. The difference in value will not be awarded to the winner.
Winner is solely responsible for any and all expenses and incidental travel costs not expressly stated in the prize description herein, including but not limited to, all ground transportation, in-room charges (e.g., mini-bar, room service, telephone, movies, etc.), other meals and beverages, gratuities, travel upgrades, baggage fees, and personal incidentals. Winner must notify Sponsor of desired dates of travel no later than forty-five (45) days prior to the desired date of departure. Winners must be available to travel by December 31, 2025 for Trail Blazer, Taste Boss, Music Maker, Serenity Seeker and Golf Entry Pools. Winner must be able to travel by March 1, 2026 for the Downhill Thrill Entry Pool. In the event the winner cannot travel to the location on the dates designated by Sponsor, winner may be disqualified and the prize may be awarded to an alternate winner provided sufficient time remains prior to the travel. Winner and guest will be required to provide a valid major credit card or some other acceptable form of payment, as determined in the hotel’s sole discretion upon hotel check-in and all in-room charges, telephone calls, meals, beverages, hotel upgrades, amenities, personal incidentals and any other expenses charged to the winner’s hotel room will be charged to that major valid credit card or deducted from the deposit provided. Travel is subject to terms and conditions set forth in these Official Rules and those set forth by selected travel providers, availability and other material restrictions may apply. Winner and guest must have all necessary identification and/or travel documents (e.g., a valid U.S. driver’s license) required for travel. Winner and travel guest must travel on same itinerary. Sponsor is not responsible for any fees or additional charges resulting from a winner’s or guest’s change to itinerary or accommodations. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations to passengers including any results thereof such as changes in services or accommodations necessitated by same. Sponsor shall not be liable for any loss or damage to baggage. If the winner becomes disabled or cannot otherwise fully enjoy the prize due to illness, Sponsor shall have the option at its sole discretion of being relieved of liability for fulfillment of the prize award and no other compensation in lieu of the prize will be awarded. Winner and guest are responsible for obtaining his/her own medical and life insurance and the associated costs. All travel is subject to any and all restrictions instituted by the Department of Defense and/or Department of Homeland Security, as required. Travel guests must sign and return a travel release before any ticketing of travel occurs. Once travel guests are selected, they may not be substituted, except in Sponsor’s sole and absolute discretion. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. All airline tickets are subject to flight variation, work stoppages, and schedule or route changes. Additional prize award details and travel information to be provided to the winner at the time of notification. Lost, stolen or damaged airline tickets, travel vouchers or certificates will not be replaced or exchanged.
Sponsor is not responsible for any delay or cancellation of prize event due to unforeseen circumstances, or those outside of Sponsor’s control. In the event, for whatever reason, any prize portion, outing, experience, or event is cancelled prior to, or during, the winner’s trip, such experience/event will not be awarded and Sponsor will not provide any compensation or substitution for that portion of the prize. Winner and guest agree to comply with all applicable venue regulations in connection with any prize portion, outing, experience, or event. Sponsor and the applicable venue representatives reserve the right to remove or to deny entry to winner and his/her guest who engage in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or act in any other objectionable behavior.
Prize(s) are taxable income to the winner(s) and winner(s) will be responsible for all taxes and fees associated with prize receipt and/or use, if any. Limit: One (1) prize per person/Shop Your Way Rewards account.
6. SWEEPSTAKES WINNER NOTIFICATION AND PRIZE CLAIM: Receiving any prize is contingent upon compliance with these Official Rules. The potential winners and any alternate potential winners are collectively referred to herein as the “Winner.” Winners are subject to verification, including verification of age.
Winners will be contacted via email and will be required to verify their/his/her/eligibility by completing, signing, notarizing and returning an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release (granting the use of the Winner’s name, city/state, likeness, or photograph by Sponsor for advertising/publicity purposes, without further compensation), a completed and signed Federal Form W-9 and a Background Check Authorization Form, by email within seven (7) calendar days of attempted notification or prize may be forfeited and an alternate Winner may be contacted. The potential winner’s guest will be sent, via a DocuSign to their email, the Background Check Authorization form and Guest Liability and Publicity Release Form and will be required to complete, sign, and return the forms via DocuSign within five (5) calendar days of receipt. At the sole discretion of the Sponsor and, if requested, the potential winner (and their guest, if any) may be required to consent to a background check. The background check may include (but is not limited to) an investigation of criminal, arrest, or conviction records, and any other factor deemed relevant by the Sponsor. If requested, such potential Winner must sign forms authorizing the release of personal and background information to the Sponsor. Pending the background check results, the Sponsor, in its sole discretion, reserves the right to limit promotional activities related to the awarding of the Prize.
Any Prize will be forfeited if: (1) a Prize notification is returned as undeliverable; (2) if any required response (including email response) is not received in a timely manner for any reason, including spam filters; (3) if any Prize claim forms or Grand Prize Winner verification materials are not returned within the required time period; (4) if, based on the results of a potential Grand Prize Winner’s background check, the Sponsor concludes that the potential Grand Prize winner is ineligible and/or is not fit to be the winner, based solely on Sponsor’s standards and decisions, as determined by Sponsor in its sole discretion; or (5) if any potential Grand Prize Winner is determined to be ineligible or otherwise not in compliance with these Official Rules; or (6) if Winner is unable or unwilling to accept the Prize or any portion thereof. Sponsor and Sweepstakes Parties are not responsible for any change mailing address, email address, and/or telephone number of entrants. Sponsor is not required to make more than one attempt to notify any individual potential Grand Prize Winner; nor is Sponsor required to make more than one attempt to verify an alternative Grand Prize Winner if a potential Grand Prize Winner is disqualified. Prize may not be awarded if the prize is not properly claimed. Unclaimed prizes will not be awarded.
Taxes: Winners are solely responsible for any taxes on the prize, and Grand Prize winner will be issued an IRS Form 1099 reporting the actual value of the Prize As a condition of winning, potential Sweepstakes Grand Prize Winner will be required to complete a W9 Tax Form and will be required to furnish his/her social security number for the sole purpose of preparation of any tax forms as required by law.
INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION. If the Sweepstakes is not capable of running as planned for any reason, including without limitation, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process, and to cancel, modify, or terminate the Sweepstakes. In the event of cancellation, Sponsor will award the prize in a random drawing from amongst all eligible, non-suspect entries received prior to termination/cancellation. In no event will more than the number of prizes stated in these Official Rules be awarded. In the event that an entry is confirmed to have been erroneously deleted, lost, or destroyed, sole remedy shall be another entry into the Sweepstakes. Sponsor may modify and amend these Official Rules as they may appear online from time to time during the Sweepstakes for clarification purposes without materially affecting the terms and conditions of the Sweepstakes.
7. PRIVACY POLICY: This Sweepstakes is offered only in the United States and is governed by the laws of the United States. Information collected by Sponsor and its agencies in connection with the Sweepstakes may be used by Sponsor and its agencies in accordance with the online Privacy Policy available at https://us.zyn.com/privacy-policy/). The information collected on the Website will be subject to and used in accordance with the Privacy Policy accessible at the Website or at https://us.ZYN.com/privacy-policy
8. LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by Sponsor, Sweepstakes Parties, resulting from user’s participation in, attempt to participate in the Sweepstakes, or download of any information in connection with participating in the Sweepstakes. No responsibility or liability is assumed by the Sponsor, Sweepstakes Parties for technical problems or technical malfunction arising in connection with any of the following occurrences, without limitation, that may affect the operation of the Promotion: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless, or Internet connectivity, or other online communication problems; errors or limitations of any Internet service providers, servers, hosts, or providers; garbled, jumbled, or faulty data transmissions; failure of any email transmissions to be sent to or received; lost, late, delayed, or intercepted email transmissions; inaccessibility of the Website in whole or in part for any reason; traffic congestion on the Internet or Website; unauthorized human or non-human intervention in the operation of the Sweepstakes, including without limitation, unauthorized tampering, hacking, theft, virus, bug, worm; or destruction of any aspect of the Sweepstakes. Sponsor is not responsible for any typographical errors in the announcement of the prize or these Official Rules, or any inaccurate or incorrect data contained on the Website. Use of Website is at user’s own risk. Sponsor and the Sweepstakes Parties are not responsible for any personal injury or property damage or losses of any kind that may be sustained to user’s or any other person’s computer equipment resulting from participation in the Sweepstakes, use of the Website, or the download of any information from the Website. As a condition of entering, entrants agree to release and hold Sponsor, the Sweepstakes Parties, and Meta harmless from any and all liability, loss, or damage incurred with respect to entrant’s participation in the Sweepstakes and the awarding, receipt, possession, and/or use or misuse of any prize.
9. BINDING ARBITRATION: To the fullest extent permitted by applicable law, any controversy or claim arising out of or relating to the Sweepstakes shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS ("JAMS Rules and Procedures") then prevailing, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply Kentucky law consistent with the Federal Arbitration Act and applicable statutes of limitations and shall honor claims of privilege recognized at law. Parties understand that they shall split the arbitration costs and each party shall pays its own respective costs and fees, including its own attorney’s fees. If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, the portion that is deemed invalid, unenforceable or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty days after the demand for arbitration is made, unless further extended by mutual agreement of the parties. THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE ENTRANT’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS SWEEPSTAKES IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES.
BY PARTICIPATING IN THE SWEEPSTAKES, EACH ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SWEEPSTAKES, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY THROUGH BINDING ARBITRATION AS SET FORTH ABOVE, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, (OTHER THAN ACTUAL OUT OF POCKET EXPENSES), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO EVERY ENTRANT.
10. PUBLICITY: Except in Tennessee, and where prohibited by law, by accepting a prize, winner grants permission for Sponsor and those acting under its authority to use his/her name, and address (city and state/province/territory), photograph, voice and/or likeness, for advertising and/or publicity purposes, in any and all media (including posting on Website) now known or hereinafter invented without territorial or time limitations and without further notice to and without additional compensation. If you are selected as the winner, your information may also be included in a publicly available winner's list.
11. GOVERNING LAW & JURISDICTION: To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Kentucky, U.S.A., without giving effect to any choice of law or conflict of law rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in Section 10 of these Official Rules and/or any judgment on an arbitration award shall be resolved exclusively in the federal, state and local courts located in Frankfort, KY. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.
