NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN.

A purchase will not increase your chances of winning. Void In VA, MA, MI, and Where Prohibited. Not Open to General Public.

1. PROMOTION OVERVIEW: This promotion will consist of an instant win game (the “Instant Win”), a limited edition item drop offer (the “Offer”), a gift with purchase (the “Gift with Purchase”), and a sweepstakes (the “Sweepstakes”) (collectively, the “Promotion”) as further outlined below.

2. ELIGIBILITY: This Promotion is open to: (i) legal residents of the fifty (50) United States and the District of Columbia (D.C.) (excluding Virginia, Massachusetts, & Michigan), (ii) who are 21 years of age at the time of entry, and (iii) who are ZYN Rewards Members as of October 1, 2024. The following individuals are not eligible to enter or win a prize: employees, contractors, directors, and officers of Swedish Match North America LLC (“Sponsor”), its parent, subsidiary and affiliated companies, and the web design, advertising, fulfillment, legal, judging, administrative, groups, clubs, organizations, commercial entities and businesses and Promotion agencies involved in the administration, development, fulfillment, and execution of this Promotion including Marketing Resources, Inc. (collectively, “Promotion Parties”), and the immediate family members (spouse, parent, child, sibling, grandparent, and spouse or "step" of each) and those living in the same household of each such person (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Promotion). Void in VA, MA, and MI and where prohibited by law and subject to all federal, state, and local laws.

3. PROMOTION PERIOD: Each Promotion piece has a separate start and end time as set forth below. Promotion begins on October 8, 2024 at 9:00 AM Eastern Time, and ends on October 14, 2024 at 4:00 PM Eastern Time (“ET”) (the “Promotion Period”):

4. PARTICIPATION IN PROMOTION PIECES:

a. How to Enter the Instant Win Game: During the Instant Win Game Period, visit us.ZYN.com/ZYNRewards (the “Website”) and log into your ZYN account. After logging in, the Instant Win Game will pop up (a “Game Play”). Limit one (1) game play per person/ZYN account for each daily Instant Win Game period.

b. How to Obtain the Limited Item Offer: During the Limited Item Offer Period, log into the Website and into your account, then search the Rewards store for a limited edition custom patterned bucket hat and purchase the hat using points. Only available while supplies last (2,000 total will be available during the Limited Item Offer Period). Limit of 2 limited items per consumer

c. How to Redeem Gift with Purchase: During the Gift with Purchase Period (while supplies last), you can visit the Website and log into your ZYN account. After logging into your account, visit the Rewards Members store and order any item in the store other than a drop-ship item or gift card to receive a custom ZYN can/bottle opener. Only 3,000 will be available and Gift With Purchase only available while supplies last, on valid purchases. If you purchase any item other than a “drop ship item” (including a gift card), your purchase will not be eligible for a gift regardless of gift availability

d. How to Enter the Sweepstakes: THERE ARE TWO WAYS TO ENTER THE SWEEPSTAKES AS FOLLOWS:

i. VIA PURCHASE - During the Sweepstakes Period, visit the Website and log into your ZYN account. After logging into your ZYN account, make a purchase in the Reward Members rewards store to receive (1) one entry into the Sweepstakes.

ii. TO ENTER THE SWEEPSTAKES WITHOUT MAKING A PURCHASE: During the Sweepstakes Period, handprint the following information legibly on a postcard: “ZYN 4th Anniversary Promotion” along with your full name, full mailing address (no P.O. boxes), phone number, email address, and date of birth. Mail your entry in an envelope with proper postage to: ZYN 4th Anniversary Promotion C/O MRi P.O Box 2117, Oak Park, IL 60303-2117. Mail in entries must be postmarked by 10/14/24 and received by 10/21/24 to be eligible. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. Sponsor is not responsible for lost, late, illegible, invalid, misdirected, mutilated, incomplete, or postage-due mail/entries, which will be disqualified. Mail-in entries become property of Sponsor and will not be returned. Each mail in entry must be in a separately postmarked envelope.

General Sweepstakes Limitations: There is a limit of one (1) Sweepstakes entry during the entire Sweepstakes Period, regardless of method of entry.

5. SWEEPSTAKES DRAWING: One (1) Grand Prize Sweepstakes winner and Four (4) Runner Ups will be selected in a random drawing on or about October 24, 2024 from among all eligible entries

received. The drawing will be conducted by a third-party administrator engaged by the Sponsor. Sponsor and administrator’s decisions shall be final and binding in all matters relating to the Promotion.

6. INSTANT WIN GAME WINNER SELECTION: Instant Win Game Prizes will be made available at two-thousand two hundred (2,200) randomly predetermined times throughout the Instant Win Game Period. To be a potential winner of an Instant Win Game, an entrant’s Game Play must have occurred at the exact randomly predetermined winning time, or, if a Game Play does not occur at the exact randomly predetermined winning time, it must be the first Game Play to occur after the exact randomly predetermined winning time, as determined by Sponsor and/or Administrator. The number of Instant Win Game Prizes available to be won will decrease during the Promotion Period as Instant Win Prizes are awarded and claimed.

7. ODDS OF WINNING AN INSTANT WIN GAME PRIZE OR SWEEPSTAKES PRIZE: Odds of winning a Sweepstakes prize depend on the number of eligible entries received. Odds of winning an Instant Win Game Prize depend on the number of eligible entries received and the order in which they were received.

8. INSTANT WIN GAME AND SWEEPSTAKES PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”):

a. Instant Win Prizes (2,200 total): The following prizes are available in the Instant Win Game (each a “Instant Win Prize”):

The total ARV of all Instant Win Prizes is $27,250

b. Sweepstakes Prizes: One (1) verified Grand Prize: will be awarded a trip for One (1) winner and one (1) guest (“Guest”) Guest must be 21+ to West Palm Beach, FL. ARV of Grand Prize: $15,000.

Grand Prize includes round-trip economy class air travel to West Palm Beach, FL. All prize details not specified herein, including hotel, airport, airline, swag details, etc. shall be selected by Sponsor at its sole discretion. All other trip and incidental expenses are the responsibility of Winner.

Four (4) Runner Ups will reach receive 4,000 ZYN Reward Points.

Total ARV: The total ARV of all Sweepstakes and Instant Win Games prizes is $42,250.

PRIZE RESTRICTIONS: Actual value of each Grand Prize may vary depending on winner’s point of travel origin, airfare and hotel fluctuations. Any difference between the stated ARV and actual value will not be awarded. Exact airport, airline, ground transportation and/or hotel accommodations will be determined by the Sponsor. Travel dates and accommodations are subject to availability and restrictions. Winner may be required to provide a credit card at time of hotel check-in to cover hotel incidentals. Prizes are non-transferable and no cash redemption or prize substitution permitted, except at the sole discretion of the Sponsor. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right in their sole discretion to substitute a prize in whole or in part with one of comparable or greater value. All costs and expenses associated with prize acceptance and use not specifically provided herein are the responsibility of the winner. The ARV for the Promotion Prize is as of the date these rules were finalized and may fluctuate. Any difference between the stated ARV and actual value at the time the prize was awarded will not be awarded.

Sweepstakes Grand Prize Details:

4 days/3-nights beach vacation for one (1) winner and one (1) guest, guest must be 21+ to West Palm Beach, FL. Trip includes round-trip economy air transportation for two (2) from a major airport nearest winner’s home to West Palm Beach, FL, three (3) nights hotel accommodations at the Four Seasons Palm Beach, ground transportation to/from the airport and hotel, an extraordinary four-course menu brimming with culinary delights curated by Executive Chef Nicolas Lebas beach side, a couples massage in the spa (awarded as $600 spa gift card) and a $500 check to be used toward any excursion of your choice

Travel Date: Grand Prize Trip must be taken between January - July 30th, 2025. Winner must notify Sponsor of desired dates of travel no later than forty-five (45) days prior to the desired date of departure. Sponsor does not guarantee transportation and accommodations will be available on the exact dates requested by Winner. No changes can be made to any trip element once it is booked/reserved.

Winner’s Guest: Winner’s Guest must be 21 years of age or older. If Grand Prize Winner does not designate an eligible Guest by the designated date specified by Sponsor, the portion of the Grand Prize related to the Guest will be forfeited. Once Guest is selected, he or she may not be substituted, except in Sponsor's sole and absolute discretion.

Travel Documents: Winner and Winner’s Guest must travel on same itinerary, comply with all security requirements for travel and are solely responsible for obtaining all necessary travel documents prior to departure date for travel (e.g., a valid government-issued passport, U.S. driver’s license). Winner and Guest are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Winner and Guest must sign and return a release of liability/publicity before travel is booked.

Travel arrangements: No changes can be made to any trip element once it is booked/reserved. Grand Prize Winner and Guest must provide their own transportation to and from the departure airport. If in the judgment of Sponsor/Administrator air travel is not required due to winner’s proximity to destination, winner will receive ground transportation in lieu of air transportation, and no compensation will be given for such substitution. Travel arrangements are subject to availability and must be round-trip. Flight itinerary may include one or more stops and/or layovers. All luggage fees, ground transportation to/from departure airport, meals, additional ground transportation while on trip, gratuities, excursions fees, beverages and any other incidental costs or other expenses not specifically set forth herein are the sole responsibility of each Winner. Airline tickets are non-refundable/non-transferable and are not valid for upgrades and/or frequent flyer miles. Airline tickets are subject to flight variations, work stoppages, and schedule or route changes. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omission whatsoever by the air carriers, hotels, venue operators, transportation companies, prize providers or any other persons providing any Grand Prize-related services or accommodations. No refund or compensation will be made in the event of the cancellation or delay of any flight. Sponsor shall not be liable for any loss or damage to baggage. Additional prize details and travel information to be provided to the winner at the time of notification. Lost, stolen or damaged airline tickets, travel vouchers or certificates will not be replaced or exchanged.

9. SWEEPSTAKES WINNER NOTIFICATION AND PRIZE CLAIM: Receiving any prize is contingent upon compliance with these Official Rules. The potential winners and any alternate potential winners are collectively referred to herein as the “Winner.” Winners are subject to verification, including verification of age.

Winners and their Guests will be contacted via email and will be required to verify their/his/her/eligibility by completing, signing, notarizing and returning an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release (granting the use of the Winner’s name, city/state, likeness, or photograph by Sponsor for advertising/publicity purposes, without further compensation), and a completed and signed Federal Form W-9, by email within 7 (7) calendar days of attempted notification or prize may be forfeited and an alternate Winner may be contacted. The Grand Prize Winner and their potential Guest will be sent, via a DocuSign email, the Background Check Authorization forms and will be required to complete, sign, and return the forms via DocuSign within seven (7) calendar days of receipt, to start the required background checks.

Any Prize will be forfeited if: (1) a Prize notification is returned as undeliverable; (2) if any required response (including email response) is not received in a timely manner for any reason, including spam filters; (3) if any Prize claim forms or Grand Prize Winner verification materials are not returned within the required time period; (4) if a potential Grand Prize Winner is found to be ineligible by civil or criminal background check, or social media information review, as determined by Sponsor in its sole discretion; or (5) if any potential Grand Prize Winner is determined to be ineligible or otherwise not in compliance with these Official Rules; or (6) if Winner is unable or unwilling to accept the Prize or any portion thereof. Sponsor and Promotion Parties are not responsible for any change mailing address, email address, and/or telephone number of entrants. Sponsor is not required to make more than one attempt to notify any individual potential Grand Prize Winner; nor is Sponsor required to make more than one attempt to verify an alternative Grand Prize Winner if a potential Grand Prize Winner is disqualified. Prize may not be awarded if the prize is not properly claimed. Unclaimed prizes will not be awarded.

Taxes: Winners are solely responsible for any taxes on the prize, and Sweepstakes Grand Prize winner will be issued an IRS Form 1099 reporting the actual value of the Prize As a condition of winning, potential Sweepstakes Grand Prize Winner will be required to complete a W9 Tax Form and will be required to furnish his/her social security number for the sole purpose of preparation of any tax forms as required by law.

GENERAL CONDITIONS: This Promotion is offered only in the United States and is governed by the laws of the United States. Information submitted in connection with this Promotion is governed by Sponsor’s Privacy Policy (available at https://us.zyn.com/privacy-policy/).

INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW INCLUDING CRIMINAL PROSECUTION. If the Promotion is not capable of running as planned for any reason, including without limitation, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Promotion, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process, and to cancel, modify, or terminate the Promotion. In the event of cancellation, Sponsor will award the prize in a random drawing from amongst all eligible, non-suspect entries received prior to termination/cancellation.

10. LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by Sponsor, Promotion Parties, resulting from user’s participation in, attempt to participate in the Promotion, or download of any information in connection with participating in the Promotion. No responsibility or liability is assumed by the Sponsor, Promotion Parties or Meta for technical problems or technical malfunction arising in connection with any of the following occurrences, without limitation, that may affect the operation of the Promotion: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless, or Internet connectivity, or other online communication problems; errors or limitations of any Internet service providers, servers, hosts, or providers; garbled, jumbled, or faulty data transmissions; failure of any email transmissions to be sent to or received; lost, late, delayed, or intercepted email transmissions; inaccessibility of the Website in whole or in part for any reason; traffic congestion on the Internet or Website; unauthorized human or non-human intervention in the operation of the Promotion, including without limitation, unauthorized tampering, hacking, theft, virus, bug, worm; or destruction of any aspect of the Promotion. Sponsor is not responsible for any typographical errors in the announcement of the prize or these Official Rules, or any inaccurate or incorrect data contained on the Website. Use of Website is at user’s own risk. Sponsor and the Promotion Parties are not responsible for any personal injury or property damage or losses of any kind that may be sustained to user’s or any other person’s computer equipment resulting from participation in the Promotion, use of the Website, or the download of any information from the Website. As a condition of entering, entrants agree to release and hold Sponsor, the Promotion Parties, and Meta harmless from any and all liability, loss, or damage incurred with respect to entrant’s participation in the Promotion and the awarding, receipt, possession, and/or use or misuse of any prize.

11. BINDING ARBITRATION: To the fullest extent permitted by applicable law, any controversy or claim arising out of or relating to the Promotion shall be settled by binding arbitration in a location determined by the arbitrator as set forth herein (provided that such location is reasonably convenient for claimant), or at such other location as may be mutually agreed upon by the parties, in accordance with the procedural rules for commercial disputes set forth in the Comprehensive Arbitration Rules and Procedures of JAMS ("JAMS Rules and Procedures") then prevailing, and

judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. The arbitrator shall be selected pursuant to the JAMS Rules and Procedures. The arbitrator shall apply Kentucky law consistent with the Federal Arbitration Act and applicable statutes of limitations and shall honor claims of privilege recognized at law. Parties understand that they shall split the arbitration costs and each party shall pays its own respective costs and fees, including its own attorney’s fees. If any part of this arbitration provision is deemed to be invalid, unenforceable or illegal (other than that claims will not be arbitrated on a class or representative basis), or otherwise conflicts with the rules and procedures established by JAMS, then the balance of this arbitration provision shall remain in effect and shall be construed in accordance with its terms as if the invalid, unenforceable, illegal or conflicting provision were not contained herein. If, however, the portion that is deemed invalid, unenforceable or illegal is that claims will not be arbitrated on a class or representative basis, then the entirety of this arbitration provision shall be null and void, and neither claimant nor Sponsor shall be entitled to arbitrate their dispute. Upon filing a demand for arbitration, all parties to such arbitration shall have the right of discovery, which discovery shall be completed within sixty days after the demand for arbitration is made, unless further extended by mutual agreement of the parties. THE ARBITRATION OF DISPUTES PURSUANT TO THIS PARAGRAPH SHALL BE IN THE ENTRANT’S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE OR JOIN THE CLAIMS OF OTHER PERSONS OR PARTIES WHO MAY BE SIMILARLY SITUATED. DO NOT ENTER THIS PROMOTION IF YOU DO NOT AGREE TO HAVE ANY CLAIM OR CONTROVERSY ARBITRATED IN ACCORDANCE WITH THESE OFFICIAL RULES.

BY PARTICIPATING IN THE PROMOTION, EACH ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY THROUGH BINDING ARBITRATION AS SET FORTH ABOVE, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, (OTHER THAN ACTUAL OUT OF POCKET EXPENSES), AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANT’S REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO EVERY ENTRANT.

12. PUBLICITY: Except in Tennessee, and where prohibited by law, by accepting a prize, winner grants permission for Sponsor and those acting under its authority to use his/her name, and address (city and state/province/territory), photograph, voice and/or likeness, for advertising and/or publicity purposes, in any and all media (including posting on Website) now known or hereinafter invented without territorial or time limitations and without further notice to and without additional compensation. If you are selected as the winner, your information may also be included in a publicly available winner's list.

13. GOVERNING LAW & JURISDICTION: To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of the Sponsor in connection

with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Kentucky, U.S.A., without giving effect to any choice of law or conflict of law rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in Section 10 of these Official Rules and/or any judgment on an arbitration award shall be resolved exclusively in the federal, state and local courts located in Frankfort, KY. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.
